Historically, although defendants have a right to discovery prior to trial, their rights to discovery pre-plea have been unclear. With many states shifting towards open-file discovery policies, we seek to examine the impact of evidence strength, among other relevant factors, on mock defendants' appraisals of their probability of conviction at trial, and decisions to plead guilty.
GUILTY PLEA PUBLIC SURVEY
95% of all criminal cases are resolved by guilty plea, yet our knowledge of the guilty plea process pales in comparison to what is known about trial processes. This project aims to gather knowledge on the process of accepting a guilty plea, and circumstances surrounding acceptance, from individuals who have been involved with the criminal justice system.
